I. Purpose
The present Service Agreement General Terms and Conditions are designed to govern the contracting of transport services for businesses supplied by the ALSA Organization as offered by ALSA GRUPO, S.L.U. via their website www.alsa.es and marketed by SERVICIOS DEL PRINCIPADO, S.A.U. (SEPRISA) a company also belonging to the , ALSA Organization. With ALSA Business your company will benefit from significant discounts on the purchase of electronic tickets via the internet destined for the use of company employees and associates, in addition to other attractive benefits. ALSA Business service is designed for both SMEs and Large Organizations (Self employed individuals and Travel Agencies are exempted).
The present General Terms and Conditions will replace any similar document or agreement previously signed between the client and ALSA.
II. Capacity to contract services
In accordance with applicable legislation, in order to contract ALSA Business services via www.alsa.es, the client/company must be in possession of the necessary legal powers as stipulated by the Laws of their corresponding country or nationality.
III. Service Description
Via their website, ALSA offers those businesses contracting the ALSA Business service access to significant discounts on the purchase via internet of electronic tickets for their employees or associates, as well as other advantageous conditions associated with the purchase of the said tickets.
For this purpose ALSA will provide the contracting client with a user friendly electronic tool which will facilitate the purchase of electronic tickets for their employees and associates, via the internet, directly from their office or business premises immediately and comfortably with the additional benefit of a significant saving in cost.
The purchase of electronic tickets will be made by the contracting company via a verified bank card which will be debited immediately on confirmation of ticket purchase.
Signing up to ALSA Business will entitle the client to a 20% discount on the purchase of electronic tickets for their employees and associates, applicable at the moment of sale. ALSA reserves the right to modify this discount after first informing the ALSA Business client of this eventuality.
IV. Agreement signing procedure
To begin the ALSA Business agreement procedure, you will need to fill in the form designed for the purpose on the website www.alsa.es. Once the form is filled in and you have accepted the terms and conditions attached on the ALSA website, your details will be verified and the registration will be completed with ALSA Business services. You will then receive an email assigning your user name and password which will then allow you to enter and login to the ALSA Business service and begin to enjoy the corresponding discounts on the purchase of electronic tickets for your employees and associates.
Regardless of the above, ALSA reserves the right to cancel ALSA Business services if any user profiles prove to be fraudulent.
V. Use of ALSA Business services. Access codes
The User Company will be fully responsible for the use and custody of any access codes assigned to the ALSA Business service. ALSA reserves the right to deny access to any companies making fraudulent use of ALSA Business services.
The user will be responsible for the security and confidentiality of their access codes. The user must inform ALSA immediately of any breach of security regulations or non-authorized use of their account of which they become aware.
The fraudulent purchase of tickets by persons outside the company or organization is prohibited and will invalidate their use. ALSA reserves the right to cancel any access codes without prejudice to any additional legal action which may result in accordance with the stipulations of the Law.
The user explicitly agrees to abstain from using the website for any illegal or immoral purposes and publicity use or to introduce or spread any electronic viruses as a result.
VI. Protection of personal data
For the compliance, supply and execution of the ALSA Business services, it will be necessary for the User Company to provide ALSA with the personal details of all employees for whom electronic tickets are purchased.
Likewise ALSA, in the normal performance of their business and compliance with their obligations as the organization selling transport tickets will need to notify the transport company supplying the service of the same aforementioned details.
For this purpose, in accordance with the stipulations of Organic Law 15/1999, dated 13th December, relating to the Protection of Personal Data, the User company declares that they have obtained the corresponding authorization from the employees and other persons to whom such personal details belong before releasing this information to ALSA, and any other companies involved, for the purpose of adequately providing the transport services contracted.
ALSA agrees to only use these personal details for the purposes of fulfilling the business obligations deriving from the present agreement.
Likewise, ALSA declares that they are fully aware of the responsibilities deriving from data protection legislation, specifically those relating to the implementation of security measures as defined under Royal Decree 1720/2007, dated 21st December, in approval of the Regulations contained within Organic Law 15/1999, dated 13th December, in relation to the protection of personal data.
In the same manner, ALSA accepts full responsibility for maintaining the secrecy and confidentiality of all personal details and other information supplied by the parties in respect of the present agreement, even after contractual relations have ceased, except where otherwise required by Law.
The exercise of all rights of access, rectification, cancellation and opposition may be performed, in accordance with current legislation, via direct request to our email address designed for the purpose: ajuridica@alsa.es, or by post to: ALSA GRUPO, S.L.U., Dpto. Asesoría Jurídica, Polígono Espíritu Santo, Calle Irlanda, Portal 5, 33010, Oviedo, attaching in all cases a photocopy of a valid D.N.I or equivalent legal identity document.
VII. Means of Payment & Billing
The full price of the tickets will be paid at the time of purchase with all the relevant discounts being simultaneously applied.
The company will have the right to obtain a direct discount applied to the final price of the tickets purchased via the ALSA Business service, but this may not be added to any other discounts or offers except those related to large families or return trip journeys. In the event of any variation in the regulations for purchase of electronic tickets by internet, ALSA will notify the User Company of these and request their agreement.
ALSA guarantees that they will treat all details relating to the means of payment employed strictly confidential. The details of the card used will be transmitted in an encrypted format via SSL security protocol, guaranteeing the secrecy of the message using coded numbers or characters.
The company may download and print individual invoices for their purchases via the corresponding section provided on the website.
VIII. Validity of the agreement
The present agreement will become valid as soon as the terms and conditions are accepted by clicking on the corresponding button on the ALSA Business Service application form.
IX. Exoneration from responsibility
ALSA will continue to supply their services employing all the technical means available to ensure they perform this service satisfactorily. ALSA will not be held responsible for any loss or damages arising from the lack of availability or technical faults which may occur to the website. In all events ALSA will employ every means at their disposal to re-establish service connection in the case of technical faults.
X. Modifications
ALSA may modify the present General Terms and Conditions at any time. In this event a new copy will be published on the website.
The user agrees and accepts that if they use ALSA Business services subsequent to the Terms and Conditions modification date, they will be considered as having agreed to the new conditions as published.
It will be the responsibility of the User to periodically check the ALSA Business Service Agreement General Terms and Conditions to ensure they are informed of any possible changes.
XI. Applicable Legislation and Jurisdiction
For the resolution of any disputes or questions which may arise in relation to these terms and conditions, governed by Spanish Law, both parties expressly agree to submit to the competent Courts and Tribunals in accordance with applicable current legislation.
